Tenant Ongoing Responsibilites and Reasons Rental Assistance may be Terminated:

 

There are many responsibilties that the VHA assign to Tenants who receive assistance from the program. Failure to comply with these responsibilities can result in penal action and even termination of assistance. The resposibilities are listed below.

 

Responsibilities:

  • Report Changes in the Member of our Family and Family Income to Vermillion Housing Authority (VHA) within 10 days of change. (Report in writing on Tenant Change Report Form)
  • Cooperate with Annual and Interim Re-examinations.
  • Maintain Housing Unit in Decent, Safe and Sanitary Condition.
  • Permit Annual and Interim Inspections
  • Use the dwelling unit solely for residence by your family - NO UNAUTHORIZED INDIVIDUALS
  • Comply with the lease agreement.
  • Make rental payments to your landlord for your portion of the rent
  • Make any utility payments not included in the rent.
  • Notify food stamps office and welfare office of any changes in rental costs
  • Give 30 days (from the first of the month) written notice to vacate, to both your landlord and Vermillion Housing Authority.
  • Notify Vermillion Housing Authority if you plan to be temporarily absent from your unit for two weeks or longer.
  • Refrain from engaging in drug-related criminal activities or violent criminal activities - this includes guests or other persons under the family's control.

 

Vermillion Housing Authority may terminate a program participant's rental assistance based on a household member's actions or failure to act based on any of the following grounds.

 

Terminations:

  • If a household member violates any of its "Family Obligations" under the program.
  • If any of the household members have been evicted from Public Housing.
  • If a Public Housing Authority has ever terminated assistance under HUD's Section 8 tenant-based program, for any member of the household.
  • If any member of the household engages in drug-related or violent criminal activity. There only needs to be a preponderence of evidence indicateing that a household member has engaged in such activity, regardless of whether the household member has been arrested or convicted.
  • If any member of the household commits fraud, defined as intent to deceive, bribery or any other corrupt or criminal act in connection with any federal housing program.
  • If the household currently owes rent or other amount to VHA, or another PHA, in connection with the Section 8 rental assistance program or Public Housing Program.
  • If the household has not reimbursed any PHA for amounts paid to an owner under Housing Assistance Payments Contract for unpaid rent, damages or vacancy claims.
  • If a household breaches an agreement with VHA to pay amounts owed to it, or another PHA.
  • If a household has engaged in, or threated, abusive or violent behavior toward VHA personnel.
  • If 180 consecutive days have passed since VHA made the last Housing Assistance Payment to the owner.
  • If a household allows an unauthorized individual to move into the assisted unit.
  • If a household fails to report all sources of income.
